(AP) - A federal appeals court says California can withhold guns for 10 days from gun buyers who previously purchased a gun and clear a background check before the 10-day waiting period.
A three-judge panel of the 9th U.S. Circuit Court of Appeals on Wednesday said the application of the state's 10-day waiting period to such gun owners was a reasonable safety precaution and didn't violate the 2nd Amendment.
The ruling overturned a lower court decision that found the law was unconstitutional when applied to existing gun owners and people with concealed weapons permits who passed background checks before the 10-day period.
Two gun owners and two gun-owner rights groups, The Calguns Foundation and Second Amendment Foundation, sued over the state waiting period in 2011.
An email to an attorney for the gun owners and groups was not immediately returned.
