Born in Dublin, Ireland (as his mother told him; he was actually born on the island of Guernsey) in 1859, composer and cellist Victor Herbert came to the US with his new wife in 1886 and became one of the most important people in American music around the turn of the 20th century; not only as a composer of operetta and popular songs, but he also championed composers' rights.
Herbert's 1909 testimony before the US Congress influenced creation of the Copyright Act of 1909, helping to secure the legal rights and royalties of composers. Building on that, with John Philip Sousa and Irving Berlin, he co-founded the American Society of Composers, Authors, and Publishers (ASCAP) in 1914, securing rights of songwriters and music publishers that continue to this day.
By 1889 Herbert was on the faculty of the National Conservatory of Music in New York City, teaching cello and composition. In the fall of 1892, Czech composer Antonín Dvořák had been recruited to become the Conservatory's director (through early 1895). Herbert even played Principal Cello in the premiere of Dvořák’s New World Symphony in December 1893. In early 1894, Herbert premiered his Cello Concerto No. 2 which Dvořák heard performed on at least two occasions. For many years, a cellist had been persistent in asking Dvořák for a cello concerto but he thought the instrument fine for inclusion in an orchestra but unsuitable as a solo instrument. That is, until he heard Herbert’s new Concerto which convinced Dvořák finally to write his own, completing it in early 1895. The Concerto that inspired Dvořák, the Cello Concerto No. 2 by Victor Herbert, is today's Midday Masterpiece.
